Slip and Fall Lawyer
Casinos and hotels are very good at this. They have an incident procedure, a risk department and footage of your fall, and they will have reviewed all three before you hear from anyone.

What you are up against
-
The property already has the footage
And an incident report written by their staff. Both were created within minutes, and neither was written with your interests in mind.
-
They will say the hazard was obvious
Open and obvious is the standard defense after a fall, and it is raised whether or not it fits the facts.
-
Notice is the whole battle
The question is whether the owner knew or should have known about the hazard. Inspection logs and sweep records answer it, and they are held by the defendant.
-
Security will ask you to give a statement
Often before you have been seen by a doctor, and sometimes before you have stood back up.
None of that has to be your problem to solve. Once we are involved, the adjusters go through us.
What to do after a slip and fall
A fall claim is decided by what the property knew and when they knew it. That sits in their records, and their records are not kept for your benefit.
-
Report it before you leave
Ask for an incident report and get the report number. A fall with no report is a fall the property will later dispute happened.
-
Photograph the hazard immediately
It will be cleaned within minutes. Photograph the substance, the floor, the lighting, any warning sign, and the absence of one.
-
Get names
Employees who responded, and any witness who stopped. Staff move between properties and shifts.
-
Keep the shoes you were wearing
Footwear becomes an issue in almost every fall claim. Do not clean them.
-
See a doctor the same day
A delay between the fall and the first medical visit is the first thing a risk department will point to.
-
Call before the footage cycles
Retention on casino and retail systems is often measured in days. A preservation letter sent quickly is frequently what saves the case.
Falls we handle
Casino floors
Spills, worn carpet transitions and poor lighting in venues that are open every hour of the day.
Hotel and resort floors
Bathrooms, pool decks and lobbies, where wet surfaces are foreseeable and warning procedures are documented.
Retail and grocery
Spills and produce debris, where sweep logs usually decide the notice question.
Stairs and escalators
Handrails, tread wear, lighting and maintenance records.
Parking structures
Uneven surfaces, oil, missing lighting and inadequate signage.
Construction and trip hazards
Cables, mats, raised thresholds and unmarked work areas in occupied buildings.
What a claim can cover
- Emergency care, surgery and ongoing therapy
- Lost income, including time lost to appointments
- Pain and suffering, and loss of enjoyment of life where mobility is affected
- Future medical costs where a fracture or back injury does not fully resolve
What decides the value
Properties argue the hazard was open and obvious or that footwear was to blame. Under NRS 41.141 that reduces recovery by your share up to 50 percent rather than ending the claim, and bars it at 51 percent.
Recovery comes from the occupier's commercial general liability policy, and sometimes from a separate contractor or cleaning company that created the hazard. Which entity actually controlled the area decides which policy answers.
No two claims carry the same value. What any particular case is worth depends on the injuries, the evidence and the coverage in place.
Their account of the fall, or yours
On your own
- Security writes the incident report, and you sign it before you have stood up properly.
- The spill is mopped and the sweep log is filed before you see a doctor.
- The camera that caught the fall records over it.
- You are told you should have watched where you were walking.
With Get The Win
- A preservation demand reaches the camera system before it loops.
- The incident report, the sweep logs and earlier falls at the same spot are obtained early.
- Your photographs, your shoes and the witnesses’ names are secured the same week.
- The claim is argued from their own logs, not from memory.
No fee unless we recover for you. A fall claim is won on what the owner knew about that floor and when, and that sits in records that do not last.
Settlements we have recovered
These are actual settlements obtained by this firm. Prior results do not guarantee or predict a similar outcome. Every case turns on its own facts, and the value of any claim depends on the injuries, the available insurance coverage and the evidence. Amounts shown are gross recoveries before fees and case costs.
The Get The Win Standard
-
01
The hazard is photographed as it was
Within an hour a spill is mopped and a broken rail is fixed. Whatever was photographed at the time is the only version of the scene that survives.
Day one -
02
An incident report is obtained
Most businesses complete one internally. It records the condition, the time and who attended, and it is far easier to obtain early than late.
First week -
03
Inspection and cleaning logs are demanded
Sweep sheets and maintenance logs establish notice. They also cycle out, which is why the demand goes early.

Footage is preserved before it loops
Retail and casino systems commonly overwrite within about thirty days. A preservation letter is what stops the clock.

Straight answers
The property says the hazard was obvious. Does that end it?
No. Open and obvious is a defense, not an automatic bar. Nevada uses comparative negligence, so even a shared responsibility reduces recovery rather than eliminating it, up to 50 percent.
How do I prove the property knew?
Inspection and sweep logs, maintenance records, prior incident reports and footage. These are held by the defendant, which is why formal preservation matters early.
Should I give the casino a statement?
Report the incident so it is recorded, then stop. A recorded statement to their risk department or insurer is not required and rarely helps you.
How long do I have to bring a slip and fall claim in Nevada?
Generally two years from the date of injury. Government-owned property carries far shorter notice requirements.
What does it cost?
Nothing up front, and no fee unless we recover compensation for you.

Where we work
The falls we take on happen on casino floors and resort walkways, in grocery aisles, and in parking structures across the valley. We can start work while you are still treating, and we do not need you in the office to do it.
Gaming regulations require casinos to keep surveillance footage for at least seven days, and for thirty days where security recorded a medical evaluation. Accepting a medical check from security on the spot therefore buys the footage of your fall more time. A grocery store or shopping center has no such rule, and its cameras may record over your fall within days unless our letter reaches it first.
